General Terms and Conditions for the Online Shop at www.riggler.eu

(with customer/consumer information)

The following General Terms and Conditions of Business also contain legal information on your rights under the regulations on distance contracts and electronic commerce, as well as other mandatory information for the benefit of consumers.

1 Scope of application, contractual partners and delivery restrictions

These General Terms and Conditions apply to all orders placed in the online shop at www.riggler.eu and to the contractual relationship in connection therewith. When placing an order, you accept the General Terms and Conditions in the version applicable at the time of placing the order.

The purchase contract is concluded with Riggler e.U., Christian Riegler, Dornberggasse 2a, 5020 Salzburg (hereinafter referred to as "we" or "Riggler").

The following delivery restrictions apply:

We only deliver to consumers. According to § 1 Abs 1 KschG, a consumer is any natural person who enters into a legal transaction that is not part of the operation of a business.

We only deliver to persons who have given their habitual residence (invoice address) in a state of the European Union and a delivery address in the European Union. Delivery to other countries is not possible.

We only allow orders in household quantities.

In our webshop, a minimum order value is not required.

2 Online purchase

Online purchase: You order online. We deliver to your home or to another delivery address in the European Union specified by you (hereinafter referred to as "online purchase").

Offer and conclusion of contract

The product presentation in the online shop does not constitute a binding offer to sell, but invites you to submit a purchase offer. When you click on the button "order with costs", you place a binding order.

A confirmation of receipt of the order is sent by an automated e-mail. However, this does not constitute acceptance of the contract by us. Regardless of the method of payment, the purchase contract is only concluded when Riggler e.U. delivers the goods or expressly confirms the conclusion of the contract by means of a separate order confirmation by e-mail.

Prices, shipping and other costs, invoice

The prices stated include the statutory value added tax of the respective country. The prices at the time of the order apply. For shipping within Austria or to Germany, we do not charge any shipping costs. For the EU-Zone 1 we charge € 8,90 changed and for the EU-Zone 2 € 9,90. For more details please see our shipping conditions.

Due to the payment method you have chosen, further costs may be incurred which are charged to you or us by third parties and over which we have no influence (e.g. credit card fees, bank fees, especially for foreign accounts). You must bear these costs and reimburse us if necessary.

Invoices are only sent electronically as pdf-documents.

 

3 Payment, retention of title

The following payment methods are available to you for the payment of the purchase price:

Prepayment: After sending your order, you will receive an e-mail from us. This e-mail will contain all the information that is important for the advance transfer of the invoice amount. As soon as we have received your payment, we will arrange for the goods to be dispatched. Your order remains reserved for you for 10 days and is then automatically deleted.

Paying by credit or debit card: Your card account will be charged with the invoice amount when the invoice is issued. We only accept Visa and Mastercard. Payments made via your credit or debit card are processed through our payment partner Shopify Payments Following the checkout process, you will be redirected to the Shopify Payments website to make your payment. Your credit/debit card account will be charged when the goods are dispatched[MW1].

If you purchase via PayPal, the amount will be charged to your PayPal account immediately after receipt of the order. You must be registered with us as a customer and logged in. In addition, you must be registered with PayPal or register there, legitimise yourself with your access data and confirm the payment order to us. You will receive further instructions during the ordering process on the website. The goods will be dispatched after completion of the payment process [MW2] . Payment with Paypal is only possible online.

Until full payment of the invoice amount of a delivery (final and complete credit note including incidental costs), we retain ownership of the goods.

 

4 vouchers

Only 1 voucher can be used per order and if the minimum order value [MW3] (according to the redemption conditions) is met. If the minimum order value is not met, the voucher will be reserved for you until the expiry date. Vouchers can neither be redeemed in CASH nor transferred to third parties.


5 Delivery and transfer of risk

The delivery of the product(s) to the agreed address is carried out in accordance with the legal regulations.

Your goods will be shipped exclusively by DPD and the Austrian Post.

The delivery time is usually 2 to 6 working days.

However, please note the corresponding information on the availability of the items in the order process.

We will inform you in case of delivery delays. Despite careful stocking, it can happen that an item is sold out sooner than expected.  The following applies: Only while stocks last.

Order and delivery address do not have to be the same. We will deliver to any address (except a PO Box address) in the European Union (just fill in the order form). This is ideal if you want to give a gift to someone or are difficult to reach at home. 6 Right of withdrawal for consumers

Consumers have a statutory right of withdrawal when concluding a distance selling transaction, which we inform about below in accordance with the statutory model.

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

In order to exercise your right of withdrawal, you must inform us (Riggler e.U. - Neualmerstrasse 33 - A-5400 Hallein) e-mail: shop@riggler.eu, Tel.: +43 6245 21663 ) by means of a clear declaration (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the attached model cancellation form, which is not mandatory.

In order to comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the revocation

If you cancel this contract, we must refund all payments we have received from you, including delivery costs, immediately and at the latest within fourteen days of the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us (you will find the correct address for the return in the package on the delivery note) immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the end of the period of fourteen days.

You shall bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

7 Questions and advice about your order or delivery.

We are available from Monday - Friday from 9:00 - 17:00 on +43 6245 21 663.

We will be happy to answer all questions in connection with an already concluded contract (order) or the processing of the contract (order handling) on +43 6245 21 663.

 - Condition of the goods, rights of the customer in case of defects, guarantee

Legal warranty rights exist for the articles available in the online shop.

Your rights in the event of material defects and defects of title shall be determined in accordance with the statutory provisions, unless otherwise stipulated below. We are liable for damages exclusively as described in § 9.

Irrespective of the colour reproduction on your end device (e.g. screen, display), there may be colour deviations between the colours of the goods displayed in the Riggler Online Shop and the actual colours of the goods. Such colour deviations do not constitute a defect of the goods.

In the event that you notice obvious damage to the packaging upon delivery, we request that you notify the transport company of this immediately and declare acceptance of the consignment "subject to reservation". We also ask you to inform us accordingly by telephone (+43 6245 21663).

No claim under the title of warranty exists in the case of defects caused by the customer, which includes in particular, but is not limited to, the following:

 

            - Damage as a result of third-party intervention

            - Improper handling

            - Mechanical damage

            - Incorrect operation by the owner or a third party

 

In addition to any statutory warranty claims against us, you may be entitled to claims under guarantees against the manufacturers of products. Please refer to the manufacturer's documents enclosed with the product upon delivery to find out whether or to what extent such claims exist.

- Liability for damages

We shall be liable for damages in accordance with the statutory provisions, unless otherwise stipulated below.

Liability towards the customer for damages arising from the use of products purchased online is excluded unless we or our legal representatives or vicarious agents can be accused of culpable conduct, intent or gross negligence and nothing to the contrary is stipulated below.

Liability for damages arising from injury to life, limb or health shall remain unaffected by the aforementioned exclusions of liability. The same applies to any claims under the Product Liability Act.

- Data protection

The protection of your personal data is of particular concern to us. We therefore process your data exclusively on the basis of the legal provisions (DSGVO, DSG2000, TKG 2003). In this data protection information, we inform you about the most important aspects of data processing within the framework of our website.

- Choice of law and place of jurisdiction

These GTC and the contractual relationship with you shall be governed by Austrian law to the exclusion of substantive uniform law, in particular the UN Convention on Contracts for the International Sale of Goods. If, in the case of delivery to Germany, any statutory provisions under German law are more favourable, these shall take precedence.

The statutory provisions shall apply to the place of jurisdiction.

 

8 Severability clause

The invalidity of individual provisions of these terms and conditions shall not affect the validity of the remaining provisions of these terms and conditions. The contracting parties are obliged to agree on a new provision that comes as close as possible to the purpose of the invalid provision.

The headings of the provisions contained in these Terms and Conditions of Sale are for convenience only and shall not be used to interpret them.

 

9 Other important customer/consumer information

Technical steps leading to the conclusion of the contract; correction of input errors

Online purchase and Click & Collect:

 

  1. log in with your access data.
  2. as soon as you have decided on a certain product, place it in the shopping basket by clicking on the button "Add to shopping basket
  3. when you have finished shopping, click on "checkout" in the shopping cart.
  4. if you are not logged in yet, please enter your access data now. If you would like to order as a guest, please enter the necessary data. Please check your data and orders and choose your preferred payment method. Vouchers or voucher codes can be redeemed at the end of the ordering process.

       5. To complete the order, click on "Order with costs".

  1. After successful completion of payment, we will send you an e-mail confirming your order. However, this does not constitute acceptance of your purchase offer.

10 Storage of the contract text and accessibility for the customer

Your order will be stored by us and - if you are registered with us as a customer - can be accessed by you via your password-protected user account. You can view your order history in your user account.

 

11 Contract language

The contract is concluded in German.

 

12 Procedure for alternative dispute resolution and online dispute resolution platform

Riggler e.U, recognises the Internet Ombudsman, Margaretenstr. 70/2/10, 1050 Vienna, www.ombudsmann.at, as an out-of-court mediator for bringing about an out-of-court settlement (information and mediation procedure).

However, this recognition does not refer to the formal conciliation procedure as described on the website www.ombudsmann.at and, in particular, Riggler e.U. does not submit to the arbitration power of the Internet Ombudsman or any other arbitration court.

The right of the contracting parties to take recourse to the ordinary courts of law at any time shall also remain unaffected.

The EU Commission has provided an online dispute resolution platform ("OS platform") under the link https://ec.europa.eu/consumers/odr since 15 February 2016. Riggler e.U. does not participate in dispute resolution proceedings before a consumer arbitration board.
