In this data protection declaration, we, as the responsible party according to Art. 4 Para. 7 EU-DSGVO, describe which data we collect from you when you visit our website and for what purpose we process it.

 

1 BASIC PRINCIPLES

The protection of your personal data is of particular concern to us. Your data will be processed exclusively on the basis of the legal provisions (DSGVO, DSG 2000, TKG 2003). The most important aspects of data processing within the framework of the website mentioned above are described below.

We only process personal data if you have given it to us voluntarily and we process it exclusively for the purpose for which it was collected. The data is processed and stored on a server of Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland, which handles the technical and operational aspects of the webshop www.riggler.eu (so-called "hosting").

 

2 VISITING THE WEBSITE

In order to visit the website, you do not have to provide any personal information. However, each time you access the website, usage data is transmitted by the respective internet browser and stored in log files ("server log files"), such as date and time, name of the (product) pages accessed and your abbreviated IP address. This data is evaluated exclusively to ensure trouble-free operation of the site and to improve our services and is then discarded. You do not allow us to draw any conclusions about your person.


3 DISCLOSURE OF PERSONAL DATA

As a matter of principle, we do not pass on your personal data to third parties. Data will only be passed on if this is necessary for the fulfilment of a contract or if you have given us your express and voluntary consent. In a few exceptional cases, we have to invoke a justified legal interest on our part. In addition, on the basis of the DSGVO, the DSG 2000 or other legal regulations, personal data may be passed on if we are legally obliged to do so (Art. 6 para. 1 p. 1 lit. c DSGVO).

 

4 HOSTING AND CONTENT DELIVERY NETWORKS (CDN)

This website is hosted by Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland, an external service provider (hoster). The personal data collected on this website is stored on the hoster's servers.

This may include, but is not limited to, IP addresses, contact requests, meta and communication data, contractual data, contact details, names, website accesses and other data generated via a website.

The hoster is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 para. 1 lit. b DSGVO) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 para. 1 lit. f DSGVO).

Our hoster will only process your data insofar as this is necessary for the fulfilment of its service obligations and will follow our instructions with regard to this data.

Shopify is responsible for any onward transfer of personal data to third parties in accordance with the EU-U.S. Privacy Shield Agreement, the Swiss-U.S. Privacy Shield Agreement and the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA).

5 WEBSHOP www.riggler.eu

The purpose of the data processing is the handling of the online shop. It is a basic requirement for you to buy the desired products from us and for us to be able to deliver them to you.

The legal basis for this data processing is the provision of Art 6 para 1 lit b of the DSGVO (necessary for the performance of the contract).

For the purpose of simplifying the ordering process and for the subsequent processing of the contract, we store your IP data in shortened form (pseudonymised) as well as the name and address of the connection holder.

In addition, we also store the following data for the purpose of processing the contract: Name, delivery and invoice address, date of birth, e-mail address, telephone number, as well as your pseudonymised credit card data, provided you have voluntarily entered this in your customer account. The data you provide is necessary for the fulfilment of the contract or for the implementation of pre-contractual measures in accordance with Art 6 (1) b of the DSGVO (for example, for the initiation and execution of the contract, the mutual correspondence for the fulfilment of the mutual obligations from this contract and the invoicing).

Without this information, it is not possible to conclude a contract. No data is transmitted to third parties, with the exception of the transmission of credit card data to the processing banking institution/payment service provider for the purpose of debiting the purchase price, to the shipping company commissioned by us for the delivery of the goods and to the tax advisor for the fulfilment of our obligations under tax law.

After the shopping process has been cancelled, the saved data will be stored in our system for another 30 days to enable you to continue the shopping process easily.

In the event that a contract is initiated or concluded, we process your personal data after the contract has been fully processed until the expiry of the warranty, guarantee, limitation and statutory retention obligations applicable to us. We also use this data until the end of any legal disputes in which it is needed as evidence.

The legal basis for this data transfer is the provision of Art 6 para 1 lit f of the DSGVO. (legitimate interest)

In the case of a payment with PayPal, we do not receive any account or credit card data. These are already stored at PayPal. We only receive the email address that you provided when you registered. The data entry itself is carried out according to PayPal's security rules.

In addition, the data is forwarded to Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland, which is responsible for hosting the webshop (see above) and also handles payment by credit or debit card (Shopify Payment).

 

6 CONTACT FORM

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you have provided there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 Para. 1 lit. b DSGVO, insofar as your enquiry is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the enquiries sent to us (Art. 6 para. 1 lit. f DSGVO) or on your consent (Art. 6 para. 1 lit. a DSGVO) if this has been requested.

The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory legal provisions - in particular retention periods - remain unaffected.

Enquiry by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your enquiry including all personal data resulting from it (name, enquiry) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.

Information about the attractiveness of our online offer is very important to us and helps us to constantly optimise our website. For this reason, we use so-called tracking pixels (small graphics) on our pages. When a page is opened, the tracking pixel is loaded from a server on the Internet and registered. In this way, we can see which internet pages have been visited by our customers, how often, from which region and which actions have been carried out. Your IP address is only recorded in abbreviated form, so that identification of the respective connection is not possible under any circumstances. The identity of the visitor therefore remains anonymous.

- Facebook plugins

Plugins of the social network Facebook (Facebook Inc., 1601 Willow Road, Menlo Park, California, 94025, USA) are integrated on our pages. You can recognise the Facebook plugins by the Facebook logo or the "Like" button on our site. You can find an overview of the Facebook plugins here.

When you visit our pages, a direct connection is established between your browser and the Facebook server via the plugin. Facebook thereby receives the information that you have visited our site with your IP address. If you click on the Facebook "Like" button while you are logged into your Facebook account, you can link the content of our pages on your Facebook profile. This allows Facebook to associate the visit to our pages with your user account. When you access a page of our website that contains such a plugin, your browser establishes a direct connection to the Instagram servers. The content of the plugin is transmitted by Instagram directly to your browser and integrated into the page. 8 NEWSLETTER

- Basics

You have the possibility to subscribe to our newsletter. With this newsletter you will regularly receive current information about our offers. For this purpose, we need your e-mail address and your explicit and voluntary consent that you agree to receive the newsletter (§ 107 TKG) and to the processing of your personal data (Art. 6 para. 1 p.1 lit. a DSGVO).

As soon as you have registered for the newsletter, we will send you a confirmation e-mail with a link to confirm your registration ("double opt-in").

You can cancel the receipt of our newsletter at any time and thereby revoke your consent at the same time with effect for the future.

Purpose:

The e-mail address you provide as well as your first and last name will be processed for the purpose of sending the subscribed newsletter. You give us your first and last name voluntarily. However, this gives us the opportunity to address you personally.

The legal basis for the processing of your email address is your consent to receive the newsletter in accordance with § 107 of the Telecommunications Act.

You have the right to revoke your consent at any time free of charge. However, the legality of the processing carried out on the basis of the consent until the revocation is not affected by your revocation. To revoke your consent, please click on the unsubscribe link in the respective newsletter or contact me directly.

The processing of your voluntarily provided information as well as the collection of data for performance measurement is based on the legitimate interests of Riggler e.U. (marketing purposes).

After unsubscribing from the newsletter, your declaration of consent will continue to be stored for the duration of the statutory limitation periods. The legitimate interests in this regard consist in the necessary documentation of your consent for evidence purposes (Art. 6 para. 1 lit f DSGVO).

You provide us with your data voluntarily, without any legal or contractual obligation. However, the processing of your email address is necessary in order to be able to send the newsletter. If you do not provide your email address, I will not be able to send you the newsletter(s).

Storage / deletion

Your unsubscription from the newsletter is automatically recorded in the newsletter database. This note means that you will not receive any further newsletters from the time of your unsubscription. The final deletion of your data will take place within one month calculated from the day of your unsubscription, as long as there are no legal storage obligations that prevent deletion.

Your rights:

In principle, you have the rights to information (Art. 15 EU-DSGVO), correction (Art. 16 EU-DSGVO), deletion (Art. 17 EU-DSGVO), restriction of processing (Art. 18 EU-DSGVO), data portability (Art. 20 EU-DSGVO) and objection (Art. 21 EU-DSGVO). If you have given separate consent to the processing of your data, you can revoke this at any time with effect for the future.
